Issue |
How should the effective date of a statute or regulation be calculated? |
Holding |
1 The effective date of a statute or regulation as provided in Article 13 of the Standard Act for the Law and Rules shall include the date of publication or proclamation. |
Reasoning |
1 When a statute or regulation provides that it will take effect from the date of publication or proclamation, the legally effective date is the third day from the date of publication or proclamation according to Article 13 of the Standard Act for the Law and Rules. It does not exclude the date of publication or proclamation when calculating the effective date and accordingly it differs from Article 120 of the Civil Code. 'Translated by J. P. Fa.
